New York Divorce Case Supreme Court rules that human organs cannot be considered marital property or part of financial disputes.

An unusual and surprising case has emerged in the United States, in which a husband demanded the return of a kidney he had donated to his former wife after their divorce. The court firmly rejected this demand and issued a clear ruling.
In its decision, the New York Supreme Court stated that human organs are not, under any circumstances, joint property of a husband and wife. The court made it clear that human organs cannot be taken back in exchange for money, nor can they be included in any legal transaction. Linking an organ such as a kidney to marriage or divorce is neither legally valid nor morally acceptable.
Court records show that Dr. Richard Batista donated his kidney in 2001 to save the life of his wife, Danielle. At that time, Danielle was seriously ill and urgently needed a kidney. The husband made this donation out of compassion and love.
“Human organs are gifts of life, not property to be exchanged or reclaimed.”
After the couple divorced, the husband argued in court that he had donated the kidney under a condition. He claimed that because the kidney was given while the marriage was intact, it should either be returned or its value compensated in the event of divorce.

He requested that the court set the kidney’s value at 1.5 million dollars. However, the court completely rejected this request, stating that human organs cannot be measured in money nor treated as part of any financial transaction.
Legal experts say this case highlights a sensitive intersection of ethics, medical principles, and marital disputes. In its ruling, the court clearly emphasized the importance of humanity, moral values, and medical ethics over financial claims.
